That Council:
1. Notes the Behavioural Standards Panel Final Report Panel Reference 25BSP-0005, and paragraph 188 of the report.
2. Notes the provisions of the Local Government Act 1999 Member behaviour—Part A1, and section 262W(4).
3. Notes the Question on Notice response at Agenda Item 19.1 of this meeting, and the decision of the South Australian Civil and Administrative Tribunal in McMahon v Knight [2024] SACAT 45.
4. Urgently commences advocacy for amendments to the Local Government Act 1999 regarding referral of former elected members to the South Australian Civil and Administrative Tribunal.
5. Requests the Chief Executive Officer exercise best endeavours to submit a motion to the next Local Government Association General Meeting seeking sector-wide support for the legislative reform outlined in point 4.
